Freedom of expression and freedom to publish are human rights under Article 19 of the Universal Declaration of Human Rights. The promotion and defence of freedom to publish is the fundamental subset of freedom of expression which is paramount for any democratic system to function adequately. It is considered as the mainstay of democracy and essential for a thriving civil society.

In the Malaysian context, the rights and liberties of the individual are recognised in the Federal Constitution of the country. The original Constitution was first introduced as the Constitution of the Federation of Malaya on 31 August 1957 (Independence Day) and subsequently as the Constitution of Malaysia on 16 September 1963 (Malaysia Day).

Article 10 of the Federal Constitution declares categorically in Clause (1) (a) that “every citizen has the right to freedom of speech and expression”. The article also guarantees Malaysian citizens the right to freedom of assembly peacefully and freedom of association. It gives the right to seek and disseminate information, and the right to be informed of various events of importance to all citizens. As in many countries, the freedom of expression in Malaysia is not absolute but subject to several restrictions as it carries with it special duties and responsibilities. These restrictions, provided by law, are necessary for respect of the rights or reputations of others, and for the protection of national security, public order, public health or morals.

The survey shows the distribution of MABOPA members by revenue year 2010-2016.

The President of MABOPA, Mr Ishak Hamzah, mentioned that one of the objectives of MABOPA is to promote and protect by all lawful means the principles of copyright and to defend copyright against all infringements which may restrict the rights of the copyright owner.

This is the ASEAN Book Publishers Association’s annual report for year 2010 which contains the minutes of the previous year meeting, and the current year countries report from the members countries.

The Malaysian Government continues to place huge emphasis on education for 2009. In fact, despite the economic downturn, the Malaysian Government has increased the spending on education to RM47.7 Billion or 23% of the 2009 Annual Budget. The Malaysian Governments’ underlying commitment is to provide equal access to quality educational opportunities for all Malaysians, notwithstanding their geographical locations or income levels. The Malaysian Government views education as a very important agenda and this augurs very well for the book industry.

The publishing business in Thailand has steadily grown since 2003, with a small decline in 2006, due to political instabilities. The estimated value of trade book sales in 2007 was around 18 billion baht, of which 88% was obtained from the sales of 110 large and medium sized publishing houses. The rest was from trade sales of 381 small size publishers, who were registered members of the Publishers and Booksellers Association of Thailand.

Malaysian publishers have been very active over the past year. Many members of the Malaysian Book Publishers Association (MABOPA) participated in regional book fairs as well as major international book fairs. Apart from that, MABOPA also organised several dialogue sessions with other related organisations to discuss various issues affecting the book industry. Many MABOPA members also attended local as well as international workshops and seminars. The membership of MABOPA has grown to 159, an increase of 30% over a 24-month period. This indicates that the industry is becoming increasingly vibrant as more players are entering the industry. To cater to a much larger membership and to improve service delivery and information sharing, MABOPA has turned to electronic means of communication by using emails and the official website extensively.

So we know now the children’s book market is very attractive but it seems that it is not easy for local publishers to succeed. Too many publishers are churning out a lot of ‘me too’ or copycat products and most of them are not investing enough in research, training, marketing, good writers, producing quality and innovative publications to add value in order to stand out from others. Publishers need to do well locally in order to excel abroad and too few Malaysian publishers are actually selling successfully overseas. To sell abroad means to compete with publishers from all over the world and the challenge is up a hundred fold and the odds are unimaginable. So far there are less than five Malaysian companies who are actually progressing in children’s book export.

Penguasaan terhadap latar belakang dan cita rasa pembaca tempatan merupakan satu-satunya kelebihan kepada penerbit tempatan. Justeru, pelbagai jenis buku yang berpotensi seperti feng syui, ekonomi, buku resipi, komik, buku bergambar, pelancongan, bahan rujukan, kesihatan, motivasi dan bacaan umum harus dititikberatkan dan dipergiatkan demi memajukan industri penerbitan dalam bahasa Cina di Malaysia. Secara keseluruhannya, intipati kedua-dua pameran buku ini nampaknya tidak secocok dengan namanya. Pameran yang bergelar pameran antarabangsa tidak cukup piawai antarabangsanya; yang menganjurkan pameran luar negara pula, penerbit luar negara yang berwibawa tidak hadir, sehinggakan kita terpaksa bertanya di manakah wujudnya penukaran fikiran antarabangsa? Apa yang dikesali ialah penyertaan penerbit-penerbit bahasa Cina tempatan dalam kedua-dua pameran buku ini amat tidak menggalakkan.  Mereka sesungguhnya kehilangan peluang bertindak secara proaktif. Akhirnya pasaran buku-buku bahasa Cina tempatan terpaksa menantikan penerokaan oleh ejen-ejen buku. Oleh Johnny Seah

Baru-baru ini, suasana industri buku tanah air mengalami gelombang perkembangan yang amat menggalakkan. Detiknya bermula dengan langkah Kerajaan mengisytiharkan agenda untuk meningkatkan ekonomi dalam rantaian nilai yang lebih tinggi; meningkatkan keupayaan pengetahuan dan inovasi negara serta memupuk minda kelas pertama. Inilah dua agenda teras yang diketengahkan di antara lima teras utama RMK9.

In principle, every country is free to design its laws on copyright and related rights according to its own needs, policy objectives, and legal traditions. Particularly, it is in the discretion of domestic lawmakers whether and to what extent they want to protect works of foreign nationals. In the early days culture-importing countries tended to grant little protection to foreign works in order to secure cheap copies for their interior markets.

One of the latest developments in the Malaysian publishing industry is the current review of the National Book Policy. The Policy, adopted in 1985, proposes that the book industry should be recognised as an essential industry and, therefore, support must be given for its development. This review is aimed at making proposals for changes which can be implemented in order to support a more vibrant, integrated and commercially healthy publishing sector able to cope with changes and move toward knowledge-based economy. One of the proposals is the restructuring of the present National Book Council to give it more strength in overseeing the implementation of the policy and the existing book related laws.
